You agree not to use the Service to:

  • infringe intellectual property or privacy rights;
  • generate, distribute, or facilitate unlawful, fraudulent, deceptive, defamatory, or abusive content;

  • Users are solely responsible for evaluating and verifying Outputs before relying on them;
  • similar or identical Outputs may be generated for multiple users;
  • availability, speed, quality, and behavior may depend on third-party model or API providers.

The Service may include safety systems, moderation controls, filters, or usage restrictions, but these are not guaranteed to detect every issue.

7. User Content

You retain ownership of your Inputs, subject to any rights necessary for us to operate the Service.

You grant us a worldwide, non-exclusive, royalty-free license to host, use, process, reproduce, adapt, transmit, and display Inputs and related content solely as reasonably necessary to:

  • provide and maintain the Service;
  • process requests and generate Outputs;
  • secure the Platform;
  • prevent abuse;
  • comply with law;
  • enforce these Terms.

You represent and warrant that you have all rights, permissions, and legal bases necessary to submit your Inputs and use the Service in connection with them.

8. Output Rights and Responsibility

As between you and fusionic.ai, and to the extent permitted by law and applicable third-party provider terms, you may use Outputs generated for you for lawful purposes.

You are solely responsible for:

  • how you use, publish, sell, distribute, or rely on Outputs;
  • ensuring that your use of Outputs complies with law, third-party rights, and platform policies;
  • reviewing Outputs for accuracy, safety, legality, and appropriateness.

We do not guarantee that Outputs are unique, non-infringing, accurate, or fit for any purpose.

9. Third-Party Services

The Service may integrate or rely on third-party services, including but not limited to AI providers, payment processors, login providers, analytics tools, media providers, search providers, and hosting or infrastructure vendors.

Your use of third-party services may also be subject to separate third-party terms and privacy policies. We are not responsible for third-party products or services, including their availability, content, accuracy, pricing, security, or policies.

10. Payments, Subscriptions, and Billing

Certain features may require paid subscriptions, credits, or one-time purchases.

By purchasing a paid service, you agree that:

  • pricing, included features, quotas, and billing terms may be displayed at checkout or in your account;
  • payments may be processed by third-party providers such as Stripe or PayPal;

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PURPOSE.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, fusionic.ai AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT PAID BY YOU TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM; OR
  • EUR 100.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

18. Indemnity

You agree to defend, indemnify, and hold harmless fusionic.ai and its affiliates, personnel, and partners from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

  • your use of the Service;
  • your Inputs or Content;
  • your violation of these Terms;
  • your violation of law or third-party rights.

19. Compliance and Export Controls

You may not use the Service in violation of trade, sanctions, export control, or similar laws. You represent that you are not prohibited from using the Service under applicable law.

20. Privacy

Use of the Service is also governed by the Privacy Policy. By using the Service, you acknowledge that personal data may be processed as described there.

21. Governing Law and Dispute Resolution

These Terms and any non-contractual disputes arising out of or in connection with them shall be governed by the laws applicable to the operator of the Service, excluding conflict of law rules, without prejudice to any mandatory consumer protection laws that may apply under applicable law.

Any disputes arising out of or relating to these Terms or the Service shall be submitted to the competent courts determined under applicable law, unless mandatory law provides otherwise.

22. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

23. No Waiver

Failure to enforce any provision of these Terms is not a waiver of that provision.

24. Entire Agreement

These Terms, together with any applicable policies, plan details, and supplemental rules, constitute the entire agreement between you and fusionic.ai regarding the Service.

25. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Platform with a revised “Last Updated” date. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the changes, unless applicable law requires otherwise.
